THREE Indian brothers, Chandru Ganglani, Bharat Ganglani and Trishul Ganglani, who are directors of a plastic company, Sacvin Nigeria Limited, were,Great Prices from Topps tile. on Monday, sentenced to one month imprisonment without an option of fine by Justice John Tsoho of a Federal High Court in Lagos, for disobeying the order of the court.
The trio were jailed by the court for flouting an interim order that was made on July 9,Credit Card Processing and Merchant Services from merchantaccountes. 2009, which restrained their company, Sacvin Nigeria Ltd, from engaging in the trade or business of manufacturing and selling or distributing the plastic products which infringed the trademark of another company, Rike Industries Limited.
Rike Industries had filed the substantive matter before the court, alleging an infringement through the act of “passing off” against Sacvin Nigeria Ltd.
The proceedings, leading to the conviction of the expatriates for contempt, were initiated by Femi Pinheiro.
It was alleged in the affidavit in support of the contempt proceedings that the plaintiff (Rike Industries Limited) was the sole authorised Nigerian manufacturer of plastic products produced in the design of VIK Singera basin mould, VIK road, neck mould and VIK mug mould, which the defendant, Sacvin Nigeria Limited, imitated, manufactured and sold to its customers.
This eventually made the court to give an interim order on July 9, 2009, restraining Sacvin from any act of engaging in the trade or business of manufacturing and selling or distributing the plastic products.
The directors of the defendant company, however, allegedly failed to obey the order and engaged continuously in manufacturing, importing, supplying, selling and distributing the said plastic products, which were identical to the plaintiff’s product.
During proceedings on Monday, counsel for the three Indian directors, Dan Olowojaiye,To interact with beddinges,The most commonly used injectionmould process, argued that his clients were not personally served and that the contempt was carried out by the company and not the directors.
However, counsel for the plaintiff, Chukwudi Enebeli, submitted that the directors were the mindset of the company.
In his ruling on the issue, Justice Tsoho, declared that any act committed by the company was attributable to its directors and then sentenced the three Indians to a month imprisonment,China professional plasticmoulds, while the case was adjourned till April 20.
